#Trump administration refers #Maine to #DOJ over #TransgenderAthletes

by Brooke Migdon - 04/11/25

"The Department of Education on Friday referred a #TitleIX investigation into Maine schools to the #JusticeDepartment after the state failed to reach a resolution with the Trump administration over a finding that it violated federal anti-discrimination law by allowing transgender students to participate in girls’ sports.

" 'The Department has given Maine every opportunity to come into compliance with Title IX, but the state’s leaders have stubbornly refused to do so, choosing instead to prioritize an extremist ideological agenda [sic] over their students’ safety, privacy, and dignity,' said Craig Trainor, acting assistant Education secretary for [WHAT A JOKE] civil rights.

"The Education Department in its announcement said it will also initiate administrative proceedings to determine whether to terminate federal #K12 education funding for Maine’s state education department, including formula and discretionary grants.

"'The Maine Department of Education will now have to defend its discriminatory practices before a Department administrative law judge and in a federal court against the Justice Department,' Trainor said. 'Governor [Janet] Mills would have done well to adhere to the wisdom embedded in the old idiom — be careful what you wish for. Now she will see the Trump Administration in court.'

"Both the Department of Education and the Department of Health and Human Services (HHS), which recently began investigating schools and states that allow transgender athletes to compete in girls’ sports, said in March that Maine had violated Title IX, the federal civil rights law against sex discrimination that the Trump White House says prohibits trans athletes from competing on girls’ and women’s teams."

Court rules federal government cannot freeze #Maine's funding from #USDA

by WGME StaffFri, April 11th 2025 at 8:46 PM

"A court says the federal government cannot freeze Maine’s funding from the Department of Agriculture.

"This comes after the USDA announced it was freezing Maine’s funding when the state would not comply with federal #TitleIX interpretations.

"Under this new ruling, the court is granting Maine a temporary restraining order, saying the federal government must unfreeze and release federal Department of Agriculture funding back to Maine.

"That includes money for things like #SchoolNutrition and #FoodBank programs.

"The Trump administration cannot freeze or withhold funding while this restraining order is in place, and the two sides will have to meet in court, though a date has not been set.

"Maine Attorney General #AaronFrey says this temporary restraining order confirms the Trump administration did not follow the rule of law when it cut program funds that go to feed school children and vulnerable adults.

" 'This order preserves Maine’s access to certain congressionally appropriated funds by prohibiting an unlawful freeze by the administration,' Frey said. “No one in our constitutional republic is above the law, and we will continue to fight to hold this administration to account.' "

#Maine takes #Trump administration to court in first lawsuit over #TitleIX dispute

The lawsuit, filed Monday by Attorney General Aaron Frey, challenges the U.S. Department of Agriculture's decision to halt federal funds over Maine's policy regarding #TransgenderAthletes.

April 7, 2025

"Maine Attorney General Aaron Frey filed a federal lawsuit against the Trump administration Monday challenging the U.S. Department of Agriculture’s decision to withhold federal funds over Maine’s policy allowing transgender athletes to compete in girls high school sports.
Frey’s office said funds withheld by the administration are used to feed children in schools, child care centers and after-school programming, as well as disabled adults in congregate settings.

"It is the first lawsuit to result from the Trump administration’s actions targeting Maine over trans athletes.

"'Under the banner of keeping children safe, the Trump administration is illegally withholding grant funds that go to keeping children fed,' Frey said in a written statement. 'This is just another example where no law or consequence appears to restrain the administration as it seeks capitulation to its lawlessness. The President and his cabinet secretaries do not make the law and they are not above the law, and this action is necessary to remind the President that Maine will not be bullied into violating the law.'"

#Trump administration targets #Maine again, this time on #transgender policy in schools

The U.S. #DepartmentOfEducation. which Trump wants to abolish, is investigating whether dozens of Maine school districts are violating or misusing federal privacy laws and infringing on parents’ rights.

by Eric Russell, March 28, 2025

"The Trump administration is once again targeting Maine over its policies on transgender youth.

"The U.S. Department of Education – an agency the president is trying to abolish – announced Friday it has initiated an investigation into Maine’s Department of Education over allegations that school districts in the state are violating the Family Educational Rights Privacy Act (#FERPA).

"Specifically, the federal agency says school districts are allowing officials to create 'gender plans' that support a transgender student’s identity but then not making those plans available to parents.

"A similar investigation was launched in #California this week.

[...]

"Schools in Maine have been caught in a legal gray area between respecting student privacy and parents’ rights to be informed when it comes to children’s expression of gender identity while at school. Many youth live in families whose members might not be supportive of their gender identity.

"The Trump administration already has been investigating Maine for allowing #TransgenderAthletes to compete, something that is allowed under the #MaineHumanRightsAct but defies an executive order the president signed in February. This month, the administration found that Maine violated the federal law known as #TitleIX and warned that if the state didn’t make changes, it would risk referral to the U.S. Department of Justice and the potential loss of tens of millions of dollars in federal funding.

"The announcement from the U.S. Department of Education this week also warns that if any Maine district is found in violation of the federal privacy act, it could lose federal funding. It’s unclear how that will play out, though, because Trump is trying to eliminate the education department at the federal level.

"A spokesperson for the Maine Department of Education did not immediately respond Friday to questions about the investigation. A spokesperson for the Maine Attorney General’s Office declined to comment.

"Trump and his supporters have elevated transgender rights as the biggest battle in the country’s culture war and believe their messaging is a political winner, even beyond traditional party lines.

"In addition to his executive order barring transgender girls or women from competing in athletics, Trump signed another that says the federal government would only recognize two genders, male and female, a move some advocates said was designed to erase transgender individuals from existence.

"Many states, Maine included, have strong protections for transgender individuals."

#MaineResists! #Maine officials refuse to sign #Trump agreement on #TransgenderAthletes

The U.S. Department of Health and Human Services said earlier this month that it would give state and local officials in Maine 10 days to sign a proposed agreement banning transgender athletes or the state would risk referral to the U.S. Department of Justice.

by Rachel Ohm, March 27, 2025

"Leaders of the Maine Principals’ Association and Greely High School say they will not sign a proposed agreement from the Trump administration requiring Maine to stop allowing transgender athletes to compete in girls’ high school sports.

"The U.S. Department of Health and Human Services gave the Maine Department of Education, Maine Principals’ Association and Greely High School 10 days to sign a proposed resolution agreement in response to its findings that Maine violated federal #TitleIX law by allowing a transgender high school student to compete in a girls’ indoor track championship last month.
Thursday marks 10 days since the Maine entities were notified of #DHHS’ findings and presented with a proposed resolution.

"'In a letter to the community Thursday, the school board of School Administrative District 51, which includes Greely High School, said the district will not sign the agreement.

"'As stated during our Board meeting on March 6th, MSAD 51 will continue to follow state law and the #MaineHumanRightsAct (#MHRA),' the letter said. 'Compliance with the proposed (agreement) would be a violation of current Maine law.'

"A spokesperson for the #MPA said Wednesday it also will not sign the agreement. The MPA also sent a letter to DHHS last week saying the federal agency doesn’t have any jurisdiction over the private non-profit organization and asking it to dismiss its finding of a violation.

"'The Maine Principals’ Association is bound by the law, including the Maine Human Rights Act (MHRA), which our participation policy reflects,' the MPA said in a statement Wednesday. 'We are unable to sign any resolution agreement that would mandate we create a new policy that would violate the law and MHRA. As such, we have not signed and will not sign the resolution agreement sent by the federal Department of Health and Human Services.'"

[...]

"The Trump administration has said it could refer the findings to the U.S. Department of Justice if the agreement is not signed. U.S. Attorney General Pam Bondi has also threatened to sue Maine if the state refuses to comply with Trump’s executive order calling for a nationwide ban on transgender student-athletes.

#Maine rebuffs #HHS order on #TransgenderAthletes

By CHELSEA CIRRUZZO and KELLY HOOPER
03/20/2025

"The governing body that oversees Maine’s school sports is rebuffing efforts by HHS’ Office for #CivilRights to penalize it for policies allowing transgender girls to play on women’s teams.

"The Maine Principals’ Association argues that HHS has no jurisdiction over the group and the issue should instead be resolved through the state legislature and Congress.

"'MPA receives no direct or indirect federal funding, so it is not beholden to Title IX enforcement by HHS and therefore cannot be included in any future investigations or litigation,' MPA said in a Wednesday statement. The group’s counsel made the same argument in a letter to HHS on Tuesday.

"How we got here: HHS said Monday it would give Maine 10 days to sign an agreement to bar transgender students from women’s sports or risk enforcement action from the Justice Department, POLITICO’s Bianca Quilantan reports.

"According to a statement by HHS, federal officials say the Maine Department of Education, the Maine Principals’ Association and Greely High School, which had a transgender student compete on a women’s team, violated #TitleIX, the anti-sex discrimination law, with their policies that allow transgender students to compete on girls’ sports teams.

"HHS had launched a brief investigation into Maine’s policies on transgender students in sports on Feb. 21 after President Donald Trump threatened Maine’s federal funding and singled out Gov. Janet Mills, a Democrat, and her state’s policies. Mills refused to say whether she would comply with his executive order barring transgender girls from girls’ sports and had vowed to meet the Trump administration in court.

"The Maine attorney general’s office said it was reviewing the proposed agreement. Greely High School did not immediately respond to requests for comment. HHS also did not respond to a request for comment."

GOOD! Bill to ban #trans athletes from girls’ and women’s sports teams fails to advance in Senate

By STEPHEN GROVES
Updated 7:27 PM EST, March 3, 2025

WASHINGTON (AP) — "Legislation that aimed to bar transgender women and girls nationwide from participating in school athletic competitions designated for female athletes failed to advance Monday night in a divided Senate as Democrats stood united against an issue that Republicans leveraged in last year’s elections.

"A test vote on the bill failed to gain the 60 votes needed to advance in the chamber as senators stuck to party lines in a 51-45 vote tally.

"The bill sought to determine #TitleIX protections 'based solely on a person’s reproductive biology and genetics at birth.' The vote came as Republicans have homed in repeatedly on the social cause, casting it as an issue of ensuring athletic fairness for women and girls.

"President Donald #Trump signed an executive order last month giving federal agencies wide latitude to ensure entities that receive federal funding abide by Title IX in alignment with the administration’s view, which interprets 'sex' as the gender someone was assigned at birth.

"Still, Republicans in Congress have set their sights on enshrining that policy into law by amending the 1972 Title IX law, which protects people from discrimination based on sex in education programs or activities that receive federal financial assistance."

#USDA Launches Compliance Review of University of Maine for #TitleIX Violations

Washington, D.C., Feb. 22, 2025— "The U.S. Department of Agriculture (USDA) has initiated a compliance review of the University of Maine following the State of Maine’s blatant disregard for President Trump’s Executive Order #EO14201

Keeping Men Out of Women’s Sports

“President Trump has made it abundantly clear: taxpayers’ hard-earned dollars will not support institutions that discriminate against women,” said U.S. Secretary of Agriculture Brooke Rollins. “USDA is committed to upholding the President’s executive order, meaning any institution that chooses to disregard it can count on losing future funding.”

"As a federally funded land-grant institution, the University of Maine receives over $100 million in USDA funding. Title IX prohibits discrimination on the basis of sex in education programs and activities that receive federal funding. Compliance with federal law is mandatory for institutions to continue receiving taxpayer funded support, including USDA grants."
