Until recently, #EmilBove was one of #Trump’s #defense lawyers, representing him in his NY criminal trial last year. The trial led to Trump’s #conviction on 34 #felony counts for falsifying business records to cover up a sex scandal that had threatened to derail his 2016 campaign.

#SDNY has long been viewed as the nation’s most prestigious US atty’s office, & has a reputation for guarding its independence & fending off interference from DC, winning it the nickname “the Sovereign District.”

Though #Trump will soon begin the #appeal process, the case will be concluded after sentencing, meaning it will no longer hover over him. But he will also be the first convicted #felon to be sworn in as president.

This week, Trump filed a civil action against the judge overseeing the case, challenging a pair of recent rulings that upheld his #conviction. Both rulings rejected Trump’s argument that, as a former & future president, he is entitled to #immunity.

Manhattan DA rebuffed #Trump’s request to dismiss his #criminal #conviction, signaling instead suggesting to freeze the case while he holds office.

In a letter to the judge, the prosecutors emphasized that a #jury had already #convicted Trump of falsifying records to cover up a sex scandal.

But acknowledging the unprecedented nature of the case—Trump would be the 1st #felon to serve as president — the prosecutors raised the prospect of a 4-yr freeze.

Missouri court vacates Sandra Hemme murder conviction, blasts attorney general's arguments

“It is incredulous that the Attorney General believes this crime evidence is not independently exculpatory,” the opinion said.

The court also criticized the St. Joseph Police Department.
“We are left with the same unmistakable impression” possessed by Horsman that the police, “ignored and buried evidence coming into its possession.”

Although 57 senators, incl’g 7 #Republicans, voted for #conviction, #MitchMcConnell did not bring more Republicans along. Had he done so, the #Senate could have #disqualified #Trump from ever running for office again.

Then there’s Biden’s AG #MerrickGarland, who dragged his feet for well over a year before taking action against the biggest threat to American #democracy since the Civil War of the 1860s. His timidity is inexplicable & disappointing.

Now perhaps the most important case in American history may never get to a #jury & the American public will never get a chance to learn about this #evidence & a jury’s judgment of this evidence before they consider returning #Trump to office.

There’s a ton of blame to go around for this situation, beginning w/then–Senate Majority Ldr #MitchMcConnell’s refusal to support Trump’s #conviction in the #Senate after the #House #impeached him.
