It imposes strict standards on "independence" drawing on CJEU practice, but is out of step with much national practice. It concludes that in house lawyers cannot represent their employer at the UPC so that parties must be represented by external lawyers. A reasonable nexus of damage occurring within the jurisdiction is all that is required. Darren Smyth (he/him)<p>The UPC local division in Mannheim has refused a language change from German to English (the language of the patent) requested by the defendants in an infringement action.
