Defendants have not yet complied with this Court's directives, and Abrego Garcia appears to remain inexplicably detained in CECOT. … the record thus far demonstrates that the United States had paid six-million dollars to house those detainees in custody "pending the United States' decision on their long-term disposition."

Judge #Xinis’ full official order in which she says the government’s definition of “facilitate“ doesn’t make sense, particularly in the context of her ruling & #SCOTUS’.

“Thus, Defendants' attempt to skirt this issue by redefining 'facilitate' runs contrary to law & logic.”

“The fallacy in the Defendants' argument is twofold. First, in the 'immigration context' as it were, …facilitating return of those wrongly deported can & has included more extensive governmental efforts, endorsed in prior precedent & DHS publications' Thus, the Court cannot credit that "facilitating" the ordered relief is as limited as Defendants suggest. Second, & more fundamentally, Defendants appear to have done nothing to aid in Abrego Garcia's release from custody & return to the United States to "ensure that his case is handled as it would have been" but for Defendants' wrongful expulsion of him. …Thus, Defendants' attempt to skirt this issue by redefining "facilitate" runs contrary to law & logic.”

LETTER ORDER REGARDING THE FILING OF DISCOVERY MOTIONS To promote the just, speedy, and inexpensive resolution of this case, see Fed. R. Civ. P. 1, the following procedure will be followed with respect to the filing of discovery motions (such as motions to compel, motions for a protective order, or motions seeking the imposition of sanctions). Any party seeking to file a motion must first serve on all parties and file with the Court a letter (not to exceed three pages, single-spaced) that includes a brief description of the proposed motion and a concise summary of the relevant factual and legal grounds. The letter should include the positions of all parties. Parties shall attach to the letter the disputed interrogatories or requests for production and the answers or responses to the same.

Last night, US Judge Sweeney in Colorado granted a district-wide (state-wide) class #habeas #TRO to stop #Trump from summarily removing *aliens* under his #AlienEnemiesAct proclamation. #ACLU attys had warned that, despite #SCOTUS ruling, Admin won't commit to providing even 24 hrs notice.

On April 7, in a 5-4 decision, the Supreme Court granted the government's application to stay the order on the basis that Petitioners had to proceed through habeas, while emphasizing that individuals who are designated under the AEA Proclamation are "entitle[d] to due process" & notice "within a reasonable time & in such manner as will allow them to actually seek habeas relief' before removal.… To date, the government has not indicated the type of notice they intend to provide or how much time they will give individuals before seeking to remove them under the AEA. However, in a hearing in the Southern District of Texas on Friday April 11, the government said they had not ruled out the possibility that individuals will receive no more than 24 hours' notice; the government did not say whether it was considering providing even less than 24 hours.

Undersigned counsel has received credible reports that, as recently as this morning, Venezuelan men at the Denver Contract Detention Facility who had been accused of Tren de Aragua affiliation were rousted from bed and told that they would be leaving the Detention Facility today. They repeatedly asked where they would be taken, and ICE officers refused to answer. They were subsequently informed that the flight they were supposed to be on had been cancelled today, and therefore, upon information and belief, they have not been removed from Colorado as of the time of this filing. Given the likelihood however that, without further clarity from the Court pending the hearing set for April 21, 2025, members of the proposed class will be systematically removed from the District and unlawfully removed under the Proclamation, Petitioners request an order clarifying that the Court's prohibition on removal applies to the proposed class as well as named Petitioners.

ORDER granting 13 Emergency Motion to Clarify. Upon review of Petitioners' emergency motion to clarify, ECF No. 13, the motion is GRANTED. The order issued by the Court at EF No. 10 prohibits the removal from this jurisdiction of Petitioners and the class they propose to represent; namely, "All noncitizens in custody in the District of Colorado who were, are, or will be subject to the March 2025 Presidential Proclamation entitled Invocation of the Alien Enemies Act Regarding the Invasion of the United States by Tren de Aragua and/or its implementation." This order shall remain in effect for no longer than fourteen (14) days, as the Court has set a hearing on this matter for April 21, 2025, and will promptly issue an order as to the motion for a TRO. It’ll be interesting to hear how she responds to the #Trump admin’s latest filing. She has been very plainspoken in her assessment of the #DOJ’s claims.

TIMELINE ABREGO GARCIA GANG ALLEGATIONS - SEPARATING FACT FROM FICTION. 2011-2019: Entry and Early Life: Kilmar Abrego Garcia flees El Salvador to the US at age 16, after M-18 gang members extort his family and threaten to kill him and rape his sisters if they didn’t keep paying. He moves in with his US citizen brother in Maryland and lives there without trouble for years. March 28, 2019: PGPD Arrest. Kilmar is arrested for loitering outside Home Depot while looking for day labor. A Prince Georges County PD detective grills him about whether he’s a gang member. He denies any involvement. Four hours later, he is transferred to ICE custody, without PGPD charging him for any offense. April 2019: ICE Allegations: At a bond hearing, ICE claims Kilmar is part of MS-13. They submit one piece of evidence: a “Gang Field Interview Sheet” (GFIS) filled out by the PGPD detective that claims Kilmar is part of MS-13. The GFIS says (1) he was wearing Chicago Bulls gear, and (2) a “confidential informant” allegedly claimed that Kilmar was a ranking member of the “Westerns” clique, which is in Long Island, a place he has never lived in.

Summer 2019: Investigation: Kilmar’s lawyers reach out to PGPD to investigate these claims. They find out that (1) the police did not even file an incident report about his arrest, and (2) the detective that filled out the GFIS has been suspended for an unknown reason. August 2019: IJ Decision: At his final bond hearing, ICE declines to offer any evidence of gang membership other than what’s in the GFIS. The IJ denies bond, finding that the GFIS is sufficient proof of membership at this time, despite noting its obvious flaws. Kilmar appeals this decision to the Board of Immigration Appeals. October 2019: Withholding Win: The immigration judge rules that Kilmar is ineligible for asylum because he filed the application too late. But the judge does grant “withholding of removal,” finding that it was “more likely than not” that he would be subject to persecution if deported to El Salvador. A removal order is issued, but with a restriction that the one country he cannot be deported to is El Salvador.

December 2019: BIA Decision: Kilmar appeals the bond decision to the Board of Immigration Appeals. The appeals board declines to find “clear error” in the immigration judge’s decision to rely on the GFIS document. However, he is released anyway because he had won withholding of removal. 2019-2025: Normal Life: Kilmar lives a normal life in Maryland with his U.S. citizen wife, their biological son, and his two stepchildren. With his work permit, he gets a job as a sheet metal worker, joins a union, and raises his family in a DC suburb. He doesn’t get into any trouble with the law. March 2025: Sent to CECOT: On March 12, 2025, ICE comes to Kilmar’s home and arrests him in front of his children. Three days later he’s transferred to Texas, where, thanks to an “administrative error,” he is put on a plane to El Salvador and sent to CECOT

In a separate document dated March 21 and reviewed by The Post, the State Department informed DHS that the revocation of Ozturk’s visa had been “approved” under the discretionary authority.
 “Due to ongoing ICE operations security, this revocation will be silent; the Department of State will not notify the subject of the revocation,” the memo says.

The memo also said that a search of U.S. government databases on Ozturk did not produce any terrorism-related information about her.
 As a result of the lack of evidence, the department said she could be deported using a different authority under the Immigration and Nationality Act that allows for the revocation of a visa at the secretary of state’s discretion.

After receiving the recommendation from DHS, the #State Dept found that while Ozturk had protested Tufts’ relationship with Israel, neither #DHS nor #ICE nor Homeland Security investigations produced any evidence showing that Ozturk has engaged in antisemitic activity or made public statements indicating support for a terrorist organization, according to U.S. government employees briefed on the State Department’s memo.
